Faculty Responsibilities and Employment Duration
Each faculty member must perform the duties described in their current Job Description, Employee Handbook, and the Faculty Handbook to assure compliance with various college polices and federal regulations. Said Manual, Description and Handbook are both incorporated herein by reference. Faculty are required to attend the Spring Workshop, Spring Invocation and Commendation and Spring Commencement. (These dates are listed in the Academic Calendar LINK www.donnelly.edu/staff/academic-calendar) Faculty are expected to be on campus Monday through Friday.
Faculty members are required to inform the immediate supervisor if they are teaching at another institution of higher learning to avoid any scheduling conflicts.
The college may terminate your appointment immediately for cause, including but not limited to: failure to perform duties in a professional and competent matter; (ii) failure to abide by applicable policies; or (iii) failure to abide by the terms of this contract. The college may also terminate your appointment if you are involved in the commission of any serious crime, public scandal, or conduct substantially impairing your professional effectiveness or your portrayal of an example for pupil emulation or promulgating teachings inconsistent with established Catholic teachings or adopting a way of life inconsistent with Catholic moral standards. If this appointment is terminated for any reason prior to the end of a semester, you will only be entitled to the portion of your salary representing the number of weeks you were employed prior to termination.
Faculty will be expected to provide their services for the full academic year. Furthermore, having a faculty member abandon a post after signing this agreement but before either the first or second semester has concluded imposes extreme hardship on the college and its students. Therefore, if you abandon your responsibilities set out in this contract, you agree to forfeit any payment of unused PTO/paid time off, (for Nursing Faculty). Unused PTO will be considered liquidated damages for the cost and inconvenience caused to the college in the event of abandonment. You also agree that this is not the exclusive remedy for breach of your appointment and is supplemental to all other damages and forms of relief otherwise permitted by law.
Faculty may decide not to continue their employment at the end of a semester; if that is the case, faculty have the right to terminate their contract after the Fall Semester, effective December 31 without cause by providing written notice, hand delivered to the Academic Dean of the College, by November 1st of the year of service. To terminate after the Spring Semester, written notice would need to be hand delivered to the Academic Dean of the College by the end of the Spring Semester. Likewise, the College may also terminate faculty employment effective at the end of a semester, without cause, by providing the faculty with written notice by the end of that semester.
If there are conflicts between the compliance/duties in the job description and the Employee Handbook and/or Faculty Handbook, the items set forth in the job description will prevail.
